Child Support

Ohio Revised Code 3109.05: (A)(1) In a divorce, dissolution of marriage, legal separation, or child support proceeding, the Court may order either or both parents to support or help support their children, without regard to marital misconduct.  In determining the amount reasonable or necessary for child support, including the medical needs of the child, the Court shall comply with Chapter 3119 of the Revised Code.

Spousal Support

“Spousal Support” is any payment made or to be made to a spouse or former spouse, or to a third party for the benefit of a spouse or former spouse, that is for sustenance and support of the spouse or former spouse.  This does not include any payment made as a part of a division or distribution of property or a distributive award.

The Court may award reasonable spousal support in divorce and legal separation proceedings upon the request of either party and AFTER it determines the division or disbursement of property.  Such an award may be allowed in real or personal property, or both, or be decreeing a sum of money payable by installments or in lump sum from future income or otherwise as the Court considers equitable.  Spousal support terminates upon the death of either party unless the order containing this award expressly provides otherwise.
